Learned counsel for the petitioner submits that the gratuity amount was paid to the employee concerned, namely Ishwar Dass and he has already died and keeping in view the judgment passed by this Court in CWP-25369-2018 titled as 'Shaminder Singh vs. The Punjab Agro Industries Corporation and another' decided on 30.09.2019, the employer has no jurisdiction to pass an order of punishment after the retirement of the employee concerned, and in the present case, the punishment order dated 12.06.2015 was passed against the employee concerned after his retirement, hence the present petition may kindly be disposed of in terms of the judgment passed in Shaminder Singh (supra).
