(ORAL) The petitioner seeks anticipatory bail in FIR No.208, dated 22.08.2022, registered at Police Station Sultanpur Lodhi, District Kapurthala, under Sections 21(C), 22 & 29 of NDPS Act, 1985. The petitioner has not joined investigation pursuant to order dated 24.01.2023 and thus, learned counsel for the petitioner submits that he may be granted another opportunity to do so. The request is being made as another FIR has also been registered against the petitioner. The submission cannot be accepted because there is no certainty that the petitioner will be granted anticipatory bail in the other case. Assuming, that he succeeds in getting relief in the said case, still, he will not be able to join investigation on account of pendency of the present case. It is thus a catch-22 situation from which petitioner can escape only after arrest.
