(ORAL) The present revision petition is directed against the impugned order 27.04.2015, whereby the application under Order 7 Rule 11 of the Code of Civil Procedure, at the instance of the petitioner-defendant, in a suit preferred by the respondent-plaintiff claiming rendition of accounts on account of open, mutual and current account, has been dismissed. Learned counsel for the parties are ad idem that the suit is already at the stage of the final arguments.

Mr. Karan Nehra, learned counsel for the petitioner-defendant submits that the second suit at the instance of the respondent-plaintiff has already been dismissed.

Keeping in view the aforementioned facts and circumstances, I am of the view that the question of court fees can always be agitated at the final stage of the suit. Leaving the question open with regard to the payment of court fee, particularly when the suit has reached at the stage of final arguments, the present revision petition is disposed of by upholding the impugned order, under challenge.

It is made clear that the trial Court shall hear the arguments of the respective parties with regard to the payment of court fee, if any.
