ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seek issuance of a writ in the nature of certiorari quashing the impugned letter/order dated 27.10.2021 (Annexure P-6) whereby, his request for supplying the Sports Gradation Certificate was rejected, ignoring his achievement and merit certificate. Petitioner claims that rejection is contrary to the Sports Gradation Policy dated 25.05.2018 notifies by the Government of Haryana.

Learned counsel for the petitioner, while relying upon Clause 5 `Category of Tournaments' of the Sports Gradation Policy dated 25.05.2018 (Annexure P-3) submits that eligible sports person can apply for gradation certificate. Pursuant thereto, the petitioner applied for Sports Gradation Certificate on the basis of his merit certificate (Annexure P-1), which clearly shows that he was a medal winner; the game was a State organized game and was affiliated to All India Football Association but still his request for issuing the same was rejected. He further submits that qua his grievance, petitioner caused issuance of a legal notice dated 11.01.2022 (Annexure P-8), the same has not been adverted by the respondents till date. Hence, the instant petition.

Learned State counsel, on advance service, joins proceedings and while referring to Rule 6.2 of the Policy submits that the claim of the petitioner was rejected vide impugned order dated 27.10.2021 (Annexure P-6) on the ground that he appeared in Junior State Football Championship Men held at Ratia (Fatehabad), whereas, Rule 6.2 of the Policy shows `the tournaments unless specifically indicated connotes senior level tournaments. The corresponding junior level tournament would be placed one category lower.' She further submits that in any case, the competent authority shall take appropriate decision on the pending legal notice dated 11.01.2022 (Annexure P-8).

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per legal notice dated 11.01.2022 (Annexure P-8) and also in view the contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of two months from today.
