Petitioner has filed the present petition under Section 528 of BNSS, 2023, for quashing of the order dated 05.12.2024 (Annexure P-3), passed by learned JMIC, Karnal, vide which, application for seeking release of Passport No.Z4705643 (Annexure P-5) of the petitioner, has been dismissed.

It is noticed that while granting regular bail to the petitioner, Coordinate Bench of this Court vide order dated 13.02.2023 (Annexure P-2), passed in CRM-M-4362-2023 (O&M), titled as, "Manish Munjal vs. State of Haryana", imposed certain conditions, and one of the condition is as under:- "8.

The petitioner shall deposit his passport, if any, with the Trial Court forthwith and in case, he does not have the passport, he shall furnish a specific affidavit in this regard." 3.

Petitioner moved an application for releasing of the passport, but without explaining therein as to for what purpose release of the passport JAWALA RAM 2025.01.29 11:46 I attest to the accuracy and authenticity of this document

CRM-M-4511-2025 - 2 - is required. Accordingly, keeping in mind the condition imposed by the High Court in the bail order dated 13.02.2023 (Annexure P-2), prayer for release of passport, has been declined by the Court below. 4.

Counsel for the petitioner submits that he be granted permission to move a fresh application before the Court below, for seeking permission to go abroad by proving necessity for such visit along with relevant documents, so that his plea for releasing the passport can be re-considered. To enable him to do so, counsel for the petitioner seeks withdrawal of present petition with liberty to file an appropriate application before the Court below.

Dismissed as withdrawn with liberty as sought and recorded here-above.
