Surinder Pal Arora and another .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Harsh Garg,Advocate for the petitioners Jaswant Singh,J.(Oral) Petitioners/plaintiffs are unfortunate widow and minor daughter of one Sandeep Kumar Arora, who have filed a suit for recovery of Rs.24,95,000/- alongwith interest and damages from the father of her husband namely Surinder Pal Arora. Plaintiffs have filed the present revision aggrieved by the order dated 20.10.2014 (P-1) passed by Civil Judge (Junior Division) Ludhiana whereby their evidence has been closed by order except permitting cross examination of PW-1.

It is averred that no doubt three opportunities have been availed for leading evidence, however, keeping in view the extreme disadvantageous position of the plaintiffs they have been unable to produce the evidence regarding compromise arrived at by their fatherin-law before the police authorities thereby admitting portion of the claim of the plaintiffs pursuant to a criminal complaint filed by the RAJINDER PRASHAD JOSHI 2015.01.27 16:56 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

After hearing the learned counsel and keeping in view the peculiar facts and circumstances of the case, I deem it appropriate to grant petitioners/plaintiffs two effective opportunities to lead their evidence.

Accordingly, present revision petition is allowed, order dated 20.10.2014(P-1) is set aside and petitioners/plaintiffs are granted two effective opportunities to lead their evidence on dates to be fixed by the learned trial Court.
