IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CWP-1545-2025 Date of Decision : January 21, 2025 GAURAV BARAK -PETITIONER V/S STATE OF HARYANA AND ORS -RESPONDENTS

CORAM:

HON'BLE MR. JUSTICE KULDEEP TIWARI

Present:

Mr. L.M. Brara, Advocate for the petitioner.

Mr. Bhupender Singh, D.A.G., Haryana.

*** KULDEEP TIWARI, J. (ORAL) 1.

Through the instant writ petition, as cast under Articles 226/227 of the Constitution of India, prayer is made for quashing the order dated 14.11.2024 (Annexure P-2) passed by the respondent No.3. 2.

Learned counsel for the petitioner submits that, the order (supra) was passed in the absence of the petitioner, and, no opportunity of hearing was granted to him.

3.

This Court has perused the order (supra), which is in fact an enquiry report submitted by the Tehsildar, Rohtak, to the Deputy Commissioner, Rohtak, on a complaint made by one private individual, namely, Prem Wati and the complaint is still pending adjudication before the Deputy Commissioner. The Deputy Commissioner has called for a fact finding report, therefore, at this stage, the instant writ petition is a premature motion.

4.

Consequently, the instant writ petition is dismissed, DEVINDER YADAV 2025.01.24 15:20 I attest to the accuracy and authenticity of this order/judgment

CWP-1545-2025 however, liberty is reserved to the petitioner to, in case he has any grievance with the impugned enquiry report, approach the Deputy Commissioner by making an apposite representation. In case any such representation is made by the petitioner, the decision in respect of EWS certificate issued to him, shall be taken only after giving him adequate opportunity of hearing.
