RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Harmandeep Singh in a case arising from FIR No.77 dated 07.10.2019 registered under Sections 21, 28, 27-A of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Khalra, District Tarn Taran.

According to the prosecution, on 07.02.2019 co-accused of the petitioner, namely, Gagandeep Singh was apprehended with conscious possession of 810 grams of heroin. During investigation, Gagandeep Singh suffered disclosure statement that the recovered heroin belonged to his coaccused Arshdeep Singh and Shinder Pal Singh alias Shindi. Petitioner used to supply heroin to Shinder Pal Singh alias Shindi. Learned counsel inter alia contends that petitioner has falsely been implicated in this case. He was not apprehended at the spot. -2CRM-M-3158 of 2020 Petitioner is in custody since 18.10.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, Harmandeep Singh is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
