( Through Video Conferencing ) **** HARSIMRAN SINGH SETHI , J. (ORAL) The grievance of the petitioner in the present writ petition is that the khal is being constructed on the land of the petitioner and that too without following the procedure as envisaged under the Haryana Canal and Drainage Act, 1974.

Learned counsel for the petitioner argues that vide order dated 11.08.2014 (Annexure P-4), the water course which has been marked as 'AB' was allowed to run for a period of one year and now, the legal representatives of Jai Bhagwan, in whose petition the order dated 11.08.2014 (P-4) was passed, want to construct a new water course again from the land of the petitioner by relying upon the order dated 11.08.2014 (P-4) and the said illegal act has already been reported to the authorities but no action has been taken by the authorities concerned to redress the grievance of the petitioner.

CWP-2174-2021 -2Learned counsel for the petitioner submits that for the relief, which is being claimed in the present writ petition, petitioner has submitted a representation dated 27.01.2021 (Annexure P-7) to respondent No.2, which is still pending consideration and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.2 to decide the said representation by passing an appropriate speaking order.

Notice of motion.

Mr. Sharad Aggarwal, AAG, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State. Learned State counsel submits that the representation dated 27.01.2021 (Annexure P-7) submitted by the petitioner will be disposed of by respondent No.2 by passing an appropriate speaking order within a period of four weeks from today.

Learned counsel for the petitioner submits that in view of the statement of the learned State counsel, the grievance of the petitioner as raised in the present writ petition stands redressed, at this stage and therefore, he does not want to press this petition any further. Ordered accordingly.

It is made clear that the respondents will be bound by their statement recorded hereinbefore.
