Again there is no representation on behalf of the petitioner. On being enquired, learned State counsel has informed that out of 14 prosecution witnesses cited, in as many as, 6 of them have been examined and the next date of hearing is fixed as 2.6.2022. Even otherwise, it is a case of recovery of contraband from the accused amounting to commercial quantity, attracting the Bar of Section 37 of the NDPS Act.
It seems that the petitioner is not interested in further prosecution of the present petition. The same stands dismissed for non-prosecution.
