(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner - Mohammed Shehzad in case FIR No.170 dated 30.10.2019 registered under Sections 15 and 21 of the Narcotic Drugs and Psychotropic Substance Act, 1985 at Police Station City-1, Tehsil Malerkotla, District Sangrur.

According to the prosecution, on 30.10.2019, 10 grams of heroin and 500 grams of poppy husk was recovered from the house of the petitioner.

Learned counsel for the petitioner inter alia contends that petitioner has falsely been implicated in this case. FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance.

In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing RAVINDER SINGH 2020.01.27 11:00 I attest to the accuracy and integrity of this document

-2CRM-M-3213 of 2020 personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of Investigating Officer only till receipt of the FSL report. He would come present as and when called for by the Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) Cr.P.C. The petition stands disposed of accordingly.
