The present Criminal Revision Petition has been filed under Section 401 Cr.P.C. against the order dated 12.12.2022 passed by the Family Court, Tarn Taran, during the pendency of a petition under Section 125 (3) of the Code of Criminal Procedure, 1973.

Counsel for the petitioners contends that the petitioners have filed an application for grant of maintenance under Section 125 Cr.P.C. and during the pendency of the said petition, the Family Court has granted interim maintenance to the tune of Rs. 4,000/- and Rs. 3,000/- per month respectively to the petitioners. The respondent did not pay the said maintenance and was in huge arrears, as such, the petitioners had filed an application under Section 125 (3) Cr.P.C. for issuance of conditional warrants and for striking of the defence of the respondent on the ground of nonpayment of arrears of interim maintenance. However, instead of issuing the warrants of arrest, the Family Court has granted one opportunity to the Nitin 2024.02.19 11:58 I attest to the accuracy and integrity of this document
CRR(F)-123-2023 (O&M) -2- 2024:PHHC:020261 respondent to conclude evidence on 19.12.2022, as well as granted the said opportunity for clearing the arrears of maintenance. 3.
After arguing for some time, counsel for the petitioners contends that now the execution application has already been filed by the petitioners for executing the order for grant of interim maintenance. 4.
In view of the aforesaid circumstances, the present petition has been rendered infructuous.

Disposed of as having been rendered infructuous. 6.
However, this Court is expected that the executing Court shall expeditiously decide the execution application. 7.
Pending miscellaneous application (s), if any, shall also stand disposed of.
