***** ARCHANA PURI, J. (Oral) As observed in the order 14.11.2025, despite service, respondent had not made appearance. Even, on the subsequent date, respondent did not make appearance. Today also, there is no representation on behalf of the respondent. As such, the respondent is hereby proceeded against ex parte.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/529/2022, titled 'Mandeep Kumar Vs. Ritu', filed by the respondenthusband, pending in the Family Court, Jind and she seeks transfer of the same to the Court of competent jurisdiction at Sonepat.
It is submitted by the counsel for the applicant that the marriage between the parties to the lis. had taken place on 17.05.2011 and one daughter born from the said wedlock, who is about 11 years old, is in the care and custody of the applicant. The applicant is not having any source of earning and is dependent upon her parental family. She has filed petition under Section 125 Cr.P.C., which is pending in the Courts at Sonepat and the respondent is pursuing the said petition.
Besides the aforesaid, also, it is submitted that the respondent is facing trial in the FIR bearing No.0193 dated 31.05.2024 under Sections 294, 323, 506 of IPC, registered at Police Station Civil Lines Jind, District Jind. However, it is submitted that since the statement of the applicant has already been recorded in the said case and the progress of trial is taken care of by the public prosecutor, therefore, she is not seeking transfer of the same. The distance between the two places is stated to be 85 kilometres.
In view of aforesaid submissions as well as taking into consideration the fact of the applicant, taking care of the minor growing daughter, who is in her custody, while she herself has no source of earning and also considering the fact of other one litigation, already pending in the Courts at Sonepat, which is pursued by the respondent and above it, the respondent not having come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/529/2022, titled 'Mandeep Kumar Vs. Ritu', filed by the respondent-husband, stands transferred from the Family Court, Jind, to the Court of competent jurisdiction at Sonepat.
aforesaid case be sent by the Family Court, Jind, to the District and Sessions Judge, Sonepat.
Learned District and Sessions Judge, Sonepat, shall assign the said petition to the Family Court, Sonepat. Even, the parties are directed to appear before the Family Court, Sonepat, within a period of one month from today onwards.
