RAMENDRA JAIN, J. (ORAL) Through this Criminal Writ Petition under Articles 226/227 of the Constitution of India prayer has been made for issuance of writ in the nature of Habeas Corpus directing the respondents to release detenue Renu Bala from Gandhi Vanita Ashram, Jalandhar.
Learned counsel for the petitioner contends that learned Magistrate vide order dated 14.10.2019 in view of her own statement of detenue/prosecutrix Renu Bala of even date under Section 164 Cr.P.C., her custody was handed over to petitioner. But the Sessions Court illegally vide impugned order dated 06.12.2019 sent detenue Renu Bala in Gandhi Vanita Ashram, Jalandhar.
Pursuant to order dated 23.01.2020 detenue Renu Bala has been produced in Court today. She, making statement on oath, has shown her willingness to go with the petitioner from the Court itself. RAVINDER SINGH 2020.02.26 19:30 I attest to the accuracy and integrity of this document
-2CRWP No.779 of 2020 In view of above, setting aside impugned order dated 06.12.2019, petitioner is permitted to take detenue Renu Bala with her. Gandhi Vanita Ashram, Jalandhar, is ordered to release detenue Renu Bala forthwith.
