LPA-195 of 2025 (O&M) 3.

Learned counsel for the parties agree that as of now, only one proceeding before the Micro, Small and Medium Enterprises Council (hereinafter referred to as 'MSME' Council) is pending against the appellant instead of two, which issue was raised in the writ petition.

Learned Senior counsel for the appellant argues that the remedy availed before the MSME Council by the respondent is not available to him, hence, the direction be given to the authorities concerned that the objection qua the jurisdiction of the MSME Council to entertain the said proceedings be decided first rather than deciding the issue on merits.

Learned counsel appearing on behalf of the respondents raises no objection.

Keeping in view the above, the present appeal is disposed of. In case, any application is filed by the appellant challenging the jurisdiction of the MSME Council, the same be decided first before entering the issue on merits.
