Convict-appellant Jasbir Singh was found guilty in this case for commission of offence under section 304 IPC and was sentenced to undergo rigorous imprisonment of ten years and to pay a fine of Rs 5000/-, in default of payment of fine, to further undergo RI for two years. The learned State counsel has placed on record custody certificate-cum-affidavit filed by Superintendent, Central Jail, Ludhiana intimating that the convict has since been released on 25.2.2006 after completion of his actual sentence by giving him benefit of remission of five years, one month and three days and he has already paid the fine in jail. Since the appellant has already undergone the sentence of imprisonment and has paid the fine, the appeal as such having become infructuous stands dismissed.
