CORAM :

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. R.S. Brar, Advocate for the petitioner.

Mr. Harsimar Singh Sitta, AAG, Punjab.

**** ANOOP CHITKARA, J (ORAL) The petitioner, who was released on parole for a period of 48 days, has come up before this Court seeking extension of time to surrender on the ground that he is in a very critical state of health and cannot move. Heard the learned State counsel.

Given the nature of order this Court proposes to pass, no response is required from the State.

Annexure P-2 (report), which has been issued by the District Hospital, SAS Nagar, Phase-6, Mohali reveals the petitioner is Covid-19 positive. However, this report is dated 11.01.2022. After that, as per the medical slip of Dhir General Hospital, #83, Preet Vihar, Mehs Gate, Nabha, dated 26.01.2022, the petitioner is not having a good health condition. The petitioner has also sent an e-mail dated 27.01.2022, Annexure P-3 seeking extension of parole before the competent authority. Without going into further details, given the third wave of pandemic (Omicron), the period of parole is extended for two weeks and the present petition is allowed. The petitioner shall surrender immediately after expiry of this extended period of two weeks.

In case, the petitioner does not recover then he may file an application for extension of time supported by the prescription slip of the doctor that he cannot move and his confinement in the jail would be dangerous to his health. There would be no need for a certified copy of this order. Any Advocate for the Petitioner can download this order along with case status from the official web page of this Court and attest it to be a true copy. In case the attesting officer wants to verify the authenticity, such an officer can also verify its authenticity and may download and use the downloaded copy for attesting bonds.
