RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for setting aside impugned Notices, dated 17.07.2017, Annexure P-1, 17.10.2022, Annexure P-3 and final Notice, dated 15.12.2023, Annexure P-4, as the same are illegal, arbitrary and unconstitutional. It is further prayed to direct respondent No.2-Deputy Commissioner to take suitable corrective steps as prayed in the representation/complaint, dated 30.12.2023, Annexure P-6, filed by the petitioner. It is also prayed to stay all further proceedings arising out of final notice, dated 15.12.2023, Annexure P-4 during pendency of the present petition.
It has been submitted by learned counsel for the petitioner that abovesaid notices have been illegally issued to the petitioner. He has submitted that earlier also in the year 2017, notice was issued and no encroachment was found and now again notice dated 15.12.2023, Annexure P-4, has been issued only to harass the petitioner. On asking of the Court, Ms.Upasana Dhawan, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondents/State and submits, on instructions from Sh.Gulshan Kumar, DCO, Sonepat, who is present in Court, that till date the petitioner has not approached the concerned authority by filing a reply to the impugned Notice. She submits that if petitioner files a reply before the competent authority, the matter would be decided in accordance with law. After hearing learned counsel for the parties and in view of the statement made by learned State counsel, the present petition is disposed of with liberty to the petitioner to file his reply to the notice within seven days from today and if any such reply is filed, the concerned authority would decide the matter expeditiously preferably within a period of two months from today in accordance with law.
