The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to issue her passport.

The petitioner is staying with her grandparents and they have adopted her. Her father has passed away and mother has got re-married. The grandparents have adopted her through a registered Adoption Deed (Annexure P-2). She has applied for passport. The respondent has kept her application pending on the ground that she has not placed on record Court decree/order in respect of his legal guardian. Mr. Arvind Seth, Advocate, submits that petitioner has been adopted by her grandparents, however, in the application, in the column of parents, she has disclosed biological parents whereas after her adoption she was supposed to disclose name of her adoptive parents. If she files fresh application disclosing her adoptive parents as parents, the passport authority would pass an appropriate order expeditiously and in accordance with law. 4.

Counsel for the petitioner agrees to the aforesaid arrangement. 5.

In the wake of statement of both sides, the petition stands disposed of.
