HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.53 dated 13.04.2021 under Sections 323,307,34,506 IPC and Sections 25,54,59 of Arms Act registered at P.S Pinangwan, Haryana. FIR was lodged on the statement made by complainant Rehmat, who alleged that his sister-in-law Jubeda was married to one Hurmat. On 10.04.2021 at about 9.00 p.m, the complainant along with his wife Farida went to the house of Jubeda on hearing some noise. They found that Warisha and Sabra (co-accused) were beating Jubeda. Complainant and his wife intervened to save Jubeda. Meanwhile, the petitioner came there. He fired a shot on the person of Farida as a result of which Farida fell down there and the petitioner ran away after threatening to kill. It is the case of prosecution that the petitioner was arrested on 09.09.2021. On his disclosure statement, the weapon of offence has been recovered.

CRM-M-4563 of 2022 #2# Farida is sister-in-law of the petitioner. The gun shot injury is caused only on the arm and that there is possibility of compromise being arrived at between the parties. The petitioner has been in custody since 09.09.2021. On the other hand, learned State counsel states that the investigation is complete and challan has been filed. Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to conclude in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Irshad is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
