Prayer in this petition is made by the petitioner for grant of interim regular bail for a period of 03 months in case arising out of FIR No.57, dated 04.10.2025, registered under Sections 21, 25 and 29 of the NDPS Act and Section 25 of the Arms Act, at Police Station SSOC, District Amritsar.

The petitioner has been booked for commission of the aforementioned offences on the allegations that on 04.10.2025, he was apprehended. 2 kgs and 500 grams of heroin and 05 pistols along with magazines were recovered from his conscious possession. He is in custody since then.

It is submitted by learned counsel for the petitioner that he has been suffering from severe limb problem and is being taken to jail hospital

-2repeatedly. He is bed ridden at the moment and is even unable to perform his day-to-day basic activities. His health is deteriorating day-by-day. Therefore, prayer has been made for extending benefit of interim regular bail to him for the period of 03 months so that he can regain his health and can get proper treatment.

The respondent/State has filed status report. A report of the Medical Officer, Central Jail, Amritsar has been tagged with the status report, as per which the petitioner is a known case of bilateral limb weakness with an associated disc bulge. Previously, he was having loss of movement of the limbs. On 13.10.2025, he was diagnosed to be unable to ambulate and required a wheelchair for mobility. On 28.01.2026 also, he had complained of difficulty in bearing weight on both lower limbs, numbness of the left lower limb and difficulty in micturition. He is a bed ridden and requires a wheelchair for mobility. As per this report, at the moment he is admitted in Central Jail, Amritsar.

Taking into consideration the report as submitted by the Medical Officer, Central Jail, Amritsar and the medical condition of the petitioner, this Court is of the considered opinion that a case is made out for extending benefit of interim regular bail to the petitioner. Accordingly, the petition is allowed and the petitioner is ordered to be admitted to interim regular bail for a period of 02 months and 20 days w.e.f. the date of his release on bail, subject to his furnishing personal as well as surety bonds to the satisfaction of the learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned and further subject to the condition that he shall ensure his appearance before the trial Court if the trial has commenced and shall not

-3absent himself during the period when he remains on interim bail. 6.

Petition stands disposed of.

Since the main petition has been allowed, pending application, if any, is rendered infructuous.
