(ORAL) Learned counsel for the petitioner has contended that the application for amendment filed by respondent No.2 herein is totally bereft of any details regarding the amendment sought. Infact, even the amended written statement was not appended with the application. Faced with the same, learned counsel for respondent No.2, on instructions, states that the present revision petition may be allowed and the impugned order dated 13.04.2018 (Annexure P-10) may be set aside. However, liberty be granted to respondent No.2 to file an application afresh, which would be decided in accordance with law. Learned counsel for respondent No.1 states that he has no objection.

CR-5586-2018 (O&M) -2In view of the statement made by learned counsel for respondent No.2, the impugned order dated 13.04.2018 (Annexure P-10) is set aside. However, respondent No.2 would be at liberty to move an application afresh. In case any application is moved for amendment of the written statement, the same shall be decided by the Court concerned in accordance with law Disposed off accordingly. Pending applications, if any, also stand disposed off.
