IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP-2038-2020 (O&M) Decided on : 06.05.2025 SUMESH KUMAR ..PETITIONER

Versus

PRESIDING OFFICER , INDUSTRIAL TRIBUNAL PATIALA AND OTHERS ...RESPONDENTS CORAM: HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI PRESENT: Ms, Sunaina, Advocate for the petitioner. None for the respondents.

**** HARSIMRAN SINGH SETHI , J. (Oral) 1.

In the present petition, the challenge is to the impugned order dated 06.11.2019 (Annexure P-9) by which, though the benefit of compensation of Rs. 30,000/- has been granted to the petitioner, but the benefit of reinstatement in service alongwith consequential benefits has not been granted to him by the Tribunal, which is arbitrary and illegal. 2.

On being asked by this Court, that as to whether the respondents-company is still operating within the State of Punjab or not. 3.

Upon this, learned counsel for the petitioner has not been able to prove that the post, on which the petitioner was working, is still in existence. Rather, the respondents No. 3 & 4 have not been served in the present petition due to incorrect addresses which shows that much less the post on which the petitioner is seeking reinstatement to challenge the impugned order dated 06.11.2019 (Annexure P-9) even the company is not in existence. Hence, no ground is made out for any interference by this Court in the facts and circumstances of the present case.
