AT CHANDIGARH CR-6002-2016 (O&M) Date of decision : 23.01.2019 Annu ... Petitioner
Versus
Surya Parkash and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr.Sumit Gupta, Advocate for the petitioner.
Mr. Dharampal, Advocate for respondent No.1.

**** AMIT RAWAL, J. (ORAL) The plaintiff-Surya Parkash sought the declaration and consequential relief of injunction that he is owner in possession of land measuring 1 bigha 18 biswas being 1/4th share out of total land measuring 7 bighas 5 biswas, by laying challenge to the sale deeds dated 05.03.2004, 15.02.2012, 28.02.2012 to be inoperative, null and void. The short point involved in the present revision petition is whether defendant No.6, petitioner herein, can be permitted to seek the indulgence of the trial Court in a suit filed by the respondent No.1-Surya Parkash, against various other defendants, to implead one Rajbir Chauhan,
YOGESH SHARMA 2019.01.25 15:57 I attest to the accuracy and integrity of this document CR-6002-2016 (O&M) simply on the ground that Rajbir Chauhan had been filing perpetual civil suits against her. The answer would be 'No', on simple application of principles of doctrine akin to dominus litus. No ground is made out for interference, much less, the impugned order cannot be said to be suffering from illegality and falsity. Accordingly, the present revision petition is dismissed. 23.01.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
