The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 25.10.1993 which expired on 24.10.2003. An FIR No. 49 dated 13.06.2009, under Sections 307, 324, 323, 34 of IPC (Section 325 IPC added later on) was registered against the petitioner at Police Station, Hariana, District Hoshiarpur. The petitioner came to be convicted vide judgment dated 25.07.2013 passed by Additional Sessions Judge ( Ad hoc), Fast Track Court, Hoshiarpur. The petitioner was awarded sentence of five years. CWP No.1573 of 2024 -2- 2024:PHHC:009143 2013 before this Court. This Court vide order dated 17.10.2014 suspended sentence of the petitioner.

Learned counsel for the petitioner inter alia contends that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 4.

Ms. Monica Chawla, Central Government Counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order within six weeks, in accordance with law. 4.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of. The petitioner is directed to appear before passport authority on 13.02.2024.
