IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CR 5646/2017 Date of decision:24.08.2017 Manjit Singh ..............Petitioner v.

Gurinder Pal Singh and another ..............Respondent Coram:

Hon'ble Mr.Justice Jaswant Singh Present:- Mr.DS Gurna,Advocate for the petitioner.

Jaswant Singh,J,(Oral).

Tenant Manjit Singh has filed the present revision against the order dated 16.9.2016 whereby the application of the tenant seeking stay of the eviction proceedings till the decision of a civil suit filed by Mohinder Singh/landlord no.1 against his son-Gurinder Pal/landlord no.2 regarding title of the demised premises, has been dismissed. The application has been dismissed on the ground that the entire evidence in the eviction proceedings is complete and the case is listed for arguments.

It is apparent that in case Gurinder Pal-landlord no.2 after withdrawal of the claim set up by landlord no.1 is unable to show that he is landlord, the eviction petition would fail. After arguing for sometime and having failed to convince Rajinder Parshad Joshi 2017.08.25 10:48 I attest to the accuracy and integrity of this document

CR 5646/2017 the Court, learned counsel for the petitioner seeks permission to withdraw the present petition.

Dismissed as withdrawn.
