IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.2356 of 2021 (O&M) DATE OF DECISION: 31.03.2021 Madan Lal .....Petitioner versus State of Punjab and others .....Respondents CORAM:- HON'BLE MRS. JUSTICE ALKA SARIN

Present:

Mr. Rajnish K. Gupta, Advocate for the petitioner ..

ALKA SARIN, J. (Oral):

Taken up through physical hearing.

The prayer in the present petition under Articles 226/227 of the Constitution of India is for issuance of a writ of mandamus directing the respondents to allot land measuring 2 bigha - 16 biswas situated in Village Nabha, Block and Tehsil Nabha, District Patiala, under the newly enacted bill known as "The Punjab (Welfare and Settlement of Landless, Marginal and Small Occupant Farmers) Allotment of State Government Land Bill, 2020" (Annexure P-5).

Learned counsel for the petitioner would contend that the petitioner has submitted a representation dated 23.12.2020 (Annexure P-6) in this regard, however, no decision has been taken on the same. The learned counsel would further contend that at this stage he limits his prayer and would be satisfied if a direction is issued to the respondents to take action/decide the representation dated 23.12.2020 (Annexure P-6) in accordance with law in a time-bound manner.

CWP No.2356 of 2021 -2Notice of motion.

On the asking of the Court, Ms. Kanica Sachdeva, AAG, Punjab, who is present in Court, accepts notice on behalf of all the respondents.

Though the prayer in the present writ petition is worded so as to relate to a Bill, infact the Punjab (Welfare and Settlement of Landless, Marginal and Small Occupant Farmers) Allotment of State Government Land Act, 2020 has received the assent of the Governor of Punjab on 11.01.2021 and was published in the Official Gazette on 12.01.2021 on which date it also came into force.

In view of the limited prayer made by the learned counsel for the petitioner, the present petition is disposed off with a direction to respondent No.3 to take a decision on the representation dated 23.12.2020 (Annexure P-6) in accordance with law expeditiously and, in any case, within a period of six months from the date of passing of this order. Disposed off accordingly.
