The present petition has been filed for directing respondent Nos.2 and 3 to promote the petitioner on the post of Lab Sahayak/Assistant from the date i.e. 07.06.2013 when her juniors were promoted. 2.

Learned counsel would contend that during the pendency of the present petition, petitioner has been promoted vide order dated 13.04.2022 (Annexure R5), however, her claim with regard to promotion w.e.f. the date of her juniors i.e. respondent Nos.4 and 5, were promoted, has not been considered. He, thus, on instructions, submits that the petitioner would be satisfied, in case, a direction is given to the respondents to consider and decide the said claim in a time bound manner.

Learned State counsel has no objection to the limited prayer made. 4.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the claim of the petitioner by taking into account the aforesaid submissions, within a period of 6 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to her and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to her interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
