Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:2

Anmoljeet Singh @ Anmol Singh 15.11.2024 61(2) of BNS, and Section 25 of Arms Act, and Sections 21/25/272A/29 of NDPS Act, State Special Operations Cell, District Intelligence Wingh (CID) Amritsar 2.

On 22.01.2025, following order was passed:2 "1.

Prayer in this petition, filed under Section 482 of BNSS, 2023 (wrongly typed as 482 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked for having committed

 the offences punishable under Section 61(2) of BNS, 2023, Section 25 of the Arms Act, 1959, and Sections 21/57/27.A/29 of the NDPS Act, 1985, in a case arising out of FIR No. 65, daed 15.11.2024, registered at Police Station State Special Operations Cell, District intelligence Wing (CID), Amritsar. 2.

As per the secret informant, petitioner is also a member of the Gang, who is involved in anti national activities. In fact, as per the allegations members of the Gang comprising of the accused . (i) Gurminder Singh @ Guri, ii) Anmoljeet Singh @ Anmol Singh, and iii) Gurpreet Singh, are in contact with Pakistani smuggler(s) "Bilal Sandhu" and he is sending consignments of arms to Dera baba Nanak Gurdaspur area along Indo.Pak border through drone and other means. 3.

Counsel for the petitioner contends that the main accused, i.e., Gurminder Singh @ Guri, has already been arrested, and recovery of arms has been effected from him. The petitioner was not even accompanying the main accused, Gurminder Singh @ Guri. The petitioner, being only 19 years of age and having no criminal history, has been involved in the present case with an ulterior motive. Moreover, there is no connecting evidence with the prosecution to prove the petitioner's direct involvement with the gang members.

Learned State counsel has filed the status report by way of affidavit of Harwinderpal Singh, PPS, Deputy Superintendent of Police, State Special Operation Cell, Amritsar, in the Court today. The same is taken on record. A copy thereof has been supplied to the opposite side. Registry is directed to tag the same at appropriate place with the paper2 book.

As per status report, neither anything has been pointed out against the petitioner; nor any other material is available with the prosecution agency, which may warrant custodial interrogation of the petitioner (young boy aged 19 years), thus, the prayer made in the present petition is accepted and same is allowed.

Accordingly, petitioner is directed to join the investigation within ten days from today. In the event of his arrest, the petitioner shall be released on bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also abide by all the conditions laid down under Section 482(2) of the BNSS, 2023. 6.

Besides, petitioner would submit/surrender his passport before the Arresting Officer and an undertaking on oath that in case of leaving the country, he would seek prior permission from the Investigating Agency/concerned Court.
