The petitioner seeks grant of regular bail in a case registered vide FIR No.317, dated 11.11.2020, Police Station Farrukhnagar, District Gurugram, under Section 20(b)(ii) of NDPS Act, wherein it is alleged that Ganja weighing 10 Kg and 200 grams was recovered from the Santro vehicle bearing registration No. HR-26-AU-2144, driven by the petitioner.

Learned counsel for the petitioner has submitted that he has falsely been implicated in the instant case and that in any case the contraband allegedly recovered falls in intermediate quantity and since the challan already stands presented he deserves the concession of bail.

Opposing the petition, the learned State counsel has submitted that since the petitioner was caught red handed along with the contraband, no case for grant of bail is made out. It has however, been informed that the petitioner as on date has been behind bars since the last about 3 months and that challan already stands presented and that the petitioner is not involved in any other case. 4.

Having regard to the nature and quantity of contraband recovered which falls in non-commercial quantity and the fact that challan already stands presented, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
