ANIL KSHETARPAL, J(Oral) Counsel for the respondent-tenant has drawn attention of the court to the order passed by a Coordinate Bench in Civil Revision No.1082 of 2008 decided on 07.12.2015 between the same parties, wherein it has been recorded that the tenant-respondent has already vacated the premises and handed over vacant possession to the landlords. Liberty was given to the tenant to revive the petition if the averments made by the landlord were incorrect. The order as noted was passed almost three years back. Admittedly, no application for revival has been filed. In view thereof, the present petition is dismissed as infructuous while granting liberty to the parties to move an application, if the facts are otherwise.
