Through this application, the applicant prays for transfer of Petition No. DMC/109/2020 under Section 13 of the Hindu Marriage Act, 1955, pending in the Court of learned Additional District Judge, Fatehgarh Sahib, Punjab to the Court of competent jurisdiction at District Ambala in the State of Haryana.

It has been pointed out that the respondent and his family members are already defending a criminal case, which was got registered by the applicant in Ambala, Haryana. It is also pleaded that the applicant is not in a position to visit Fatehgarh Sahib and pursue her case effectively. She also claims that she is living with her parents and is not financially independent.

Transfer Application No. 99 of 2021 allowed. The case i.e. Petition No. DMC/109/2020 under Section 13 of the Hindu Marriage Act, 1955, is transferred to the Court of competent jurisdiction at District Ambala in the State of Haryana. The transferor Court is requested to remit the file to the transferee Court forthwith. Since the parties are not present today in the Court, therefore, the transferee Court shall issue notice to the parties of the date fixed for hearing of the case.
