Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0201 dated 29.12.2018 under Section 15 of the NDPS Act, registered at Police Station Bhogpur, District Jalandhar.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that there was secret information against Jasvir Singh, owner of Gazal Dhaba and one Majhar Shah that they are dealing in the business of smuggling poppy husk and supplying the same. CRM No.M-3522 of 2019 -2As per the allegations, a truck was found parked at Dhaba during the raid and 8 quintal 56 Kg. poppy husk was recovered from accused Munish Kumar and 5 Kg. poppy husk was recovered from accused Rakesh Kumar. As per the allegations, petitioner Jasvir Singh was sitting in a car and he fled away in the car.
Nothing has been recovered from the present petitioner. Nothing has been recovered from the Dhaba owned by him. There was only secret information against the present petitioner. There is nothing cogent, at this stage, to connect the petitioner with the offence. Keeping in view the facts and circumstances of the present case, I find merit in the present petition and the same is allowed. It is ordered that in the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, he shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
