ANIL KSHETARPAL, J (Oral) Defendant has filed the present revision petition against order dated 17.09.2016 (Annexure P-1), whereby the evidence of the defendants No.2 to 4 has been closed by order on the ground that the case is ten years old.
Counsel for the petitioner submits that the trial Court has closed the evidence after granting two opportunities to the defendants. According to learned counsel for the petitioner, first opportunity to lead evidence was granted on 20.08.2016 and second opportunity was on 03.09.2016, i.e. with a gap of 14 days and by impugned order, the evidence has been ordered to be closed.
Taking into consideration the facts and circumstances of the case, I deem it appropriate to grant defendants-petitioner two more effective opportunities within a period of one month. Civil Revision No.6283 of 2016(O&M) -2shall grant two more effective opportunity to the defendants-petitioner to conclude its entire evidence on a date to be fixed by the trial court within a period of one month.
