(ORAL) Through this revision under Section 401 Cr.P.C., the petitioner has prayed for setting aside the order dated 27.11.2018 of the learned Additional Sessions Judge, Fatehgarh Sahib, whereby the petitioner was directed to deposit 20% of the cheque amount before the trial Court, for paying the same to the complainant, as a condition precedent for the admission of appeal against the judgment of conviction dated 29.10.2018 (Annexure P-1) of the trial Court.
Referring to order dated 14.02.2019 of a co-ordinate Bench of this Court passed in CRR-228-2019 'Anu Goel Vs. Amarjeet Singh and others', learned counsel for the petitioner contends that in similar circumstances, condition of deposit of the amount of compensation has been stayed.
Having given thoughtful consideration to the submissions of learned counsel for the petitioner, this Court is not inclined to stay the operation of impugned order. However, in the fitness of things, the RISHU KATARIA 2019.03.05 18:38 I attest to the accuracy and integrity of this document
CRR-232-2019 (O&M) -2impugned order dated 27.11.2018, is modified to the extent that petitioner is directed to deposit 20% of the cheque amount before the trial Court, who shall convert the same into STDR, in some nationalized bank fetching maximum rate of interest to save loss of interest of the party, who shall finally be held entitled for the same.
Disposed of, accordingly.
Registry is directed to send a copy of this order to the trial Court, for compliance.
