M.M.S. BEDI, J (ORAL) Petitioner-wife is a BDS doctor whereas the respondent-husband is stated to be a big landlord having business of brick kiln and luxury cars like Skoda Octavia etc. It is claimed that maintenance pendente lite under Section 24 of the Hindu Marriage Act is inadequate. The petitionerwife had claimed a sum of Rs.35,000/- per month as maintenance pendente lite and Rs.50,000/- as litigation expenses. The divorce petition has been filed by the respondent in Sri Muktsar Sahib whereas the petitioner-wife at present is staying at Jaipur. Taking into consideration the totality of the circumstances, I deem it appropriate to enhance the amount of maintenance pendente lite from Rs.5,000/- per month to Rs.10,000/- per month w.e.f., the date of application as apparently the petitioner RAJ KUMAR ARORA 2015.03.13 12:09 I attest to the accuracy and integrity of this document

CR-6070-2014 (O&M) is an able bodied young man having landed property. When he had married a BDS, he is presumed to be earning at least Rs.30,000/- to Rs.50,000/- per month.

The petition is allowed. The petitioner-wife will be entitled to maintenance pendente lite @ Rs.10,000/- per month from the date of application. She will also be entitled to litigation expenses of Rs.25,000/-.
