In a suit for partition where a preliminary decree is granted, the defendant who contested the suit has preferred an appeal and asked for stay of passing of final decree. The stay has not been granted and it appears that the case is being adjourned from time to time. The revision petition is filed against the proceedings of the Appellate Court to point out that the appropriate direction must be given for immediate disposal. Yet another revision petition is against the order of the trial Court declining to stay its own proceedings after a preliminary decree is passed.

Both the revision petitions are untenable and cannot be supported. I dismiss them both.
