The following order was passed on 09.01.2024:- "Relief claimed in this writ petition is qua a Private NonBanking Housing Finance Company. As none had appeared on behalf of petitioner on 17.10.2023, writ petition was adjourned with the observation that "learned counsel for petitioner would also address arguments qua entertainability of this writ petition, keeping in view the judgment of Hon'ble the Supreme Court in Phoenix ARC Private Limited versus Vishwa Bharti Vidya Mandir and others, 2022 (1) RCR (Civil) 888. On next date of hearing i.e. 24.11.2023 matter was adjourned at joint request of learned counsel for the parties on the ground that a settlement may be arrived at.

Today, despite the matter being called twice, there is no representation on behalf of petitioner. It appears that petitioner is not interested in pursuing the matter any longer. 3.

Writ petition is accordingly dismissed in default and for non prosecution.
