Challenge in this revision petition is to order dated 11.09.2015 passed by learned Civil Judge (JD) Tarn Taran, vide which the application filed by the defendant/petitioner (herein after to be referred as 'the petitioner'), has been dismissed and the application filed by the plaintiff/respondent for comparison of thumb impression stands allowed.

The petitioner is claiming ownership to the extent of 1⁄2 share in view of the registered sale deed dated 28.03.1995 executed by Kabal Singh. This sale deed has been produced by the petitioner and has led its sufficient evidence. The onus was on Kabal Singh to prove the execution of the above said sale deed and thus the application filed by respondent No. 1 for comparison of thumb impression, has GAURAV ARORA 2015.12.11 14:13 I attest to the accuracy and integrity of this document

C.R. No. 6406 of 2015 -2been rightly allowed.
