AMIT RAWAL J. (Oral) Petitioner-husband is aggrieved of the impugned order dated 19.08.2016, whereby, the case was adjourned to 06.09.2016 for awaiting the report from Mediation and Conciliation Centre and for cross examination of PW5 Munish Singla, petitioner and for remaining evidence of the petitioner. Mr. Pankaj Jain, learned counsel appearing on behalf of the petitioner-husband submits that it would be totally against the principles of equity and fair play. In case the petitioner is able to compromise the matter before the Mediation and Conciliation Centre, he would be unnecessarily subjected to wrath of cross examination.
I have heard learned counsel for the petitioner and appraised the paper book and of the view that so long as the matter is pending before Mediation and Conciliation Centre, the impugned order shall be kept in Savita 2016.09.29 16:49 I attest to the accuracy and integrity of this document High Court Chandigarh
CR No.6392 of 2016 {2} abeyance as issue in dispute between the husband and wife is sensitive one and the Court should not have ordered for cross examination of the petitioner as witness but after it came back from the Mediation and Conciliation Centre, trial shall proceed in accordance with law. With the aforementioned observation, the revision petition stands disposed of.
