Petitioner/tenant is in revision against the judgment dated 25.5.2017 passed by learned Appellate Authority,Hoshiarpur whereby he has been ordered to evicted from the demised shop,situated at Court Road,Maluk Singh Saini Market,Hoshiarpur on the ground of "personal necessity" of the landlady.
After arguing for sometime, and having failed to convince the Court on merits, learned Counsel for the petitioner(tenant) submits that he would not press this revision petition provided some reasonable time is granted to make alternative arrangement to shift medical store from the demised premises being run from the demised shop since 1992. It is further submitted that petitioner is also willing to pay increased rent @ Rs.1500/- per month for the time so granted.

CR 6036/2017(O&M) In view of nature of the order being passed, it is not felt necessary to issue notice to the respondents/landlady so as to avoid delay in the matter and to save her from unnecessary litigation expenses. In view of the above, this petition is dismissed as not pressed, however, nine months time commencing w.e.f. 01.10.2017 is granted to the petitioner-tenant for making alternative arrangement subject to his furnishing an undertaking on or before 28.9.2017 before the Court of learned Rent Controller, Hoshiarpur, that he shall hand over actual physical vacant possession of the demised premises to the respondents/ landlady by 30.06.2018. The undertaking shall also state that the entire arrears of rent, if any, at the admitted rate of Rs.1000/- per month have been cleared and petitioner shall pay future rent @ Rs.1500/- per month w.e.f. 1.10.2017 to 30.6.2018, by 7th of each calendar month.
