******* SURINDER GUPTA, J.(Oral) After arguing for some time, learned counsel for the petitioners seeks permission to withdraw this petition with prayer that petitioners be allowed reasonable time for vacating and handing over the possession of the demised premises to the respondents-landlord. In view of request made by learned counsel for the petitioners, this petition is dismissed as withdrawn. Keeping in view the fact that petitioners are tenant in demised premises for last about 70 years, request of learned counsel for petitioners for grant of reasonable time to petitioners to vacate the premises is allowed and the revision petitioners are allowed time up to 30.06.2019 to vacate and hand over the vacant possession of the demised premises to the respondents-landlord, subject to the following terms:- (i) The petitioners-tenant will pay/deposit the entire due rent Jyoti 2018.01.09 11:16 I attest to the accuracy and authenticity of this document
CR-6-2018 -2upto 31st January 2018 within two weeks.
(ii) They will keep on paying/depositing the advance rent/mesne profits of subsequent months upto 30.06.2019 on or before 7th day of each month.
(iii) They will file affidavit before the Executing Court within three weeks giving details of entire payment of rent/mesne profits and undertaking to vacate and hand over the vacant possession of the demised premises to the respondents on or before 30.06.2019. In case of default in compliance of any of the above terms, the respondents-landlord will be entitled to execute the order of ejectment forthwith.
The order has been passed in the absence of respondents to avoid unnecessary delay and expenses. A copy of this order be conveyed to the respondents. In the event of respondents having any objection, they may file application to that effect. On receipt of the application, the same be listed for hearing.
