The present petition under Articles 226/227 of the Constitution of India has been filed for issuance of a writ in the nature of mandamus directing the respondents to pay the unpaid retiral benefits such as Gratuity, Leave Encashment and Furlough Leave, Pension and Commutation of Pension along with 9% per annum interest on delayed payment of retiral benefits.
Learned counsel for the petitioners would contend that the petitioners have served Legal Notices dated 08.01.2021 (Annexures P-6 and P-7) in this regard. However, no action has been taken on the same. The learned counsel would further contend that at this stage he limits his prayer and would be satisfied if a direction is issued to the respondents to take a decision on the Legal Notices dated 08.01.2021 (Annexures P-6 and P-7) in accordance with law in a time-bound manner.

In view of the limited prayer made by the learned counsel for the petitioners, the present petition is disposed off with a direction to respondent No.2 to take a decision on the Legal Notices dated 08.01.2021 (Annexures P-6 and P-7) by passing a speaking order in accordance with law expeditiously and, in any case, within a period of two months from the date of receipt of a certified copy of this order and in case the petitioners are found entitled to the benefits, as claimed, the same may be released to them within a period of two months thereafter.
