Learned counsel for respondent No.1 has pointed out that vide order dated 17.07.2023 the Trial Court was directed to adjourn the proceedings beyond a date fixed in this Court and prior to the said date, on 22.05.2023, final arguments were partly heard. The learned counsel has further pointed out that the application under Order 7 Rule 11 of the Code of Civil Procedure, 1908 was filed only on the ground that the suit was barred by limitation. It was urged by the learned counsel for respondent No.1 that during the pendency of the revision petition, an application was filed for framing of an additional issue qua limitation which has also been framed and the evidence has been led by both the parties. 2.

Faced with the same, the learned counsel for the petitioner seeks permission to withdraw the present revision petition with liberty to raise all the pleas before the Trial Court. Permitted to do so. Yogesh Sharma 2025.03.12 09:42 I attest to the accuracy and authenticity of this order/judgment.
