***** ARCHANA PURI, J. (ORAL) In consonance with the order dated 09.09.2024, passed by this Court, the counsel for the respondent has submitted that the compromise has in fact, reached between the parties, with the intervention of the Mediator. Now, both the parties intend to file petition under Section 13-B of the Hindu Marriage Act.

In the light of the compromise, the counsel for the respondent gives an undertaking that the petition under Section 13 of the Hindu Marriage Act, pending in the Courts at Karnal, shall be withdrawn by the respondent, within a period of ten days from today onwards and on that very day, the petition under Section 13-B of the Hindu Marriage Act, shall be filed.

TA-101-2024 In view of the undertaking given by the counsel for the respondent, the counsel for the applicant submits that he does not want to pursue with the present application and the same may be dismissed as withdrawn, with liberty to file afresh, in the eventuality of the petition under Section 13 of the Hindu Marriage Act, not being withdrawn and the petition under Section 13-B of the Hindu Marriage Act, not being filed. Ordered accordingly.
