Mr. Keshav Pratap Singh, Advocate for the petitioner. B.S.WALIA, J (ORAL) [1] Learned counsel states that the only relief prayed for is for issuing directions to the learned trial Court to expedite decision on the application under Order 39 Rules 1 & 2 CPC, which is pending adjudication for the past more than two years.
[2] In view of the orders, I propose to pass, no notice is being issued to the respondents as the same would entail unnecessary delay and expenses being incurred by the respondents in engaging counsel as there are 171 respondents.
[3] Accordingly, after hearing learned counsel for the petitioner and perusing the paper book and without expressing any opinion on the merits of the case, the revision petition is disposed of by directing the learned trial Court to consider and decide the application under Order 39 Rules 1 & 2 CPC in accordance with law as expeditiously as possible. [4] Disposed of in the above terms.
