**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 84 dated 13.7.2019 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Maqsudan, Jalandhar, District Jalandhar. Learned counsel for the petitioner submits that recovery of 137 grams of intoxicant tablets containing salt of Tramadol Hydrochloride was effected from co-accused Baij Nath Jaiswal and he has been granted regular bail by this Court vide order dated 22.11.2019 (Annxure P-3). He further submits that 700 intoxicant tablets containing salt of Tramadol Hydrochloride were allegedly recovered from the petitioner and he has been in custody since 13.7.2019 and no other case is pending against him. Learned State counsel, on instructions from ASI Gurdial Singh, submits that in the present case, charges have been framed and the witnesses are yet to be examined.

As per the custody certificate, the petitioner has been in custody since 15.7.2019. Charges have been framed and the witnesses are yet to be examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
