(ORAL) The present revision petition under Article 227 of the Constitution of India has been filed impugning the order dated 03.08.2018 (Annexure P-5) whereby the affidavit dated 07.05.2001 was permitted to be placed on record in additional evidence.

Learned counsel for the parties are ad idem that the impugned order be set aside inasmuch as no application for additional evidence was filed by respondent No.1 herein and only an application for placing on record certified copy of affidavit dated 07.05.2001 had been filed. In view of the above statement, the impugned order dated 03.08.2018 (Annexure P-5) is set aside. Respondent No.1 is given an opportunity to file an application for additional evidence which shall be dealt with by the Court below in accordance with law.
