    !"#$% &' This is an application filed by the petitioner for appointing an arbitrator for resolution of the disputes in terms of clause314 of the agreement between the parties.

It is undisputed that though the first party i.e. non3applicant3 respondent before this Court was entitled to appoint the arbitrator, however, the same was not done by the first party within the time stipulated under the provisions of the Arbitration and Conciliation Act, 1996.      2!3 Before this Court, the applicant3petitioner has given the names of three persons for being appointed as arbitrator. Learned counsel for the petitioner and the respondent agreed to appoint Er. Arvind Kumar Gupta (retired) as an arbitrator.

In view of the consent of the parties and in terms of the provisions of Section 11 of the Act, Mr. Arvind Kumar Gupta, Chief Engineer (Retd.), # 102, Aashiana Luxuries, 2143A, Saket, Meerut3250003 UP, is appointed as an arbitrator to adjudicate upon the disputes between the parties. The fees shall be as per the Chandigarh Arbitration Centre (CAC) (Administrative Cost and Arbitrators' Fees) Rules, 2014 or as may be settled by the parties and the arbitrator.

The petition stands disposed of.
