Krishan Lal v. Sudha Kapoor And Another
In the High Court of Punjab and Haryana, at Chandigarh Civil Revision No. 664 of 2020 Date of Decision: 30.01.2020 Shri Krishan Lal ... Petitioner(s)
Versus
Smt. Sudha Kapoor and Another ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal
Present:
Mr. Gursimran Singh Madaan, Advocate for the petitioner(s).
Anil Kshetarpal , J.
The tenant/petitioner has filed the present revision petition against the order dated 10.01.2020 passed by the learned Rent Controller rejecting the application for recall of Sudha Kapoor and Deepika Kapoor, who had appeared in evidence on behalf of the landlady. The learned Court below has found that mere change of counsel is not sufficient to allow recall of the witnesses. Normally, a witness should not be allowed to be recalled unless the Court finds that some serious prejudice is going to be caused. Still further, the tenant wants to prove that the landlady is owner of the other premises. Such evidence can be led by the tenant when an opportunity is given to him. Hence, no ground is made out to interfere.
Dismissed.
